These Terms of Service govern your access to and use of dozerdrop.com, including any purchase you make through the website.

The website and store are operated by Doma Beauty Pty Ltd, trading as Dozer, ABN 69 667 515 433. In these Terms, “Dozer”, “we”, “us” and “our” refer to that company.

By accessing our website, creating an account, placing an order or otherwise using our services, you agree to these Terms of Service and the policies referenced in them.

Please read these Terms carefully before using our website or purchasing a product.

1. Our Store

Dozer sells limited-edition, made-to-order sleep products and related goods.

Our store is hosted by Shopify, which provides the ecommerce platform through which we offer our products and services.

These Terms apply alongside our:

  • Return & Refund Policy
  • Shipping Policy
  • Privacy Policy
  • any other terms or notices displayed on our website

If there is a conflict between these Terms and a mandatory law that applies to you, the mandatory law will prevail to the extent of that conflict.

2. Eligibility and Account Information

You must be legally capable of entering into a binding agreement to place an order.

If you are under the legal age of majority where you live, you may only use the website or place an order with the involvement and consent of a parent or legal guardian.

You agree to provide accurate, complete and current information when using our website or placing an order.

If you create an account, you are responsible for:

  • maintaining the confidentiality of your login details
  • activity conducted through your account
  • notifying us promptly if you suspect unauthorised access

You must not transfer, sell or assign your customer account to another person.

3. Products

We make reasonable efforts to display and describe our products accurately.

However, you acknowledge that:

  • colours may appear differently depending on your screen or device settings
  • dimensions may vary slightly within normal manufacturing tolerances
  • sublimation printing may result in minor variations in colour or print placement
  • stitching, fabric alignment and finishing may vary slightly between individually manufactured products

Minor manufacturing variations that do not materially affect the appearance, quality or functionality of a product do not necessarily constitute defects.

Product descriptions, specifications and availability may be updated where reasonably necessary. We may discontinue a product or limit its availability at any time.

4. Made-to-Order Products

Our products are generally manufactured after an order is placed.

Because production may begin shortly after your order is submitted, we cannot guarantee that an order can be changed or cancelled once production has started.

Please check your product selection, quantity, delivery address and contact information carefully before completing checkout.

5. Limited-Edition Drops

Some products are offered as limited releases or “drops”.

A quantity advertised for a particular drop refers to the quantity made available through that release.

Unless we expressly state that a design will never return, we may:

  • reproduce a design in a later drop
  • offer an updated or modified version of a design
  • release the design on another product
  • make additional quantities available in the future

Adding a product to your cart does not reserve it. An order is not secured until checkout has been completed and payment has been successfully processed.

We may reasonably limit quantities purchased by one customer, household, account, payment method or delivery address, particularly for limited releases.

6. Orders

When you place an order, you are making an offer to purchase the selected products under these Terms.

An automated order confirmation acknowledges that we received your order. It does not necessarily mean that your order has been accepted or entered production.

We may decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable
  • payment cannot be authorised
  • pricing or product information contains an obvious error
  • the delivery address is incomplete or cannot be serviced
  • we reasonably suspect fraud or unauthorised activity
  • the order breaches these Terms or applicable law

If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled item or order.

We will contact you using the details supplied at checkout if an issue affects your order.

7. Prices and Currency

Product prices may vary according to your selected market, country or currency.

Our store’s base currency is United States dollars unless otherwise stated. Shopify may display local-market prices using currency conversion, market-specific pricing or applicable rounding adjustments.

The amount payable by you will be displayed at checkout before you submit your order.

Unless otherwise stated, product prices do not include shipping charges, import duties or charges that are not collected by us at checkout.

We may change prices at any time. A price change will not affect an order that we have already accepted.

If a product is displayed at an obviously incorrect price, we may cancel the affected order and provide a full refund.

8. Taxes, Duties and Customs Charges

Taxes collected by us will be displayed at checkout where applicable.

International orders may be subject to customs duties, import taxes or other government charges imposed by the destination country.

Unless these charges are expressly included at checkout, you are responsible for paying them.

We do not control customs authorities and cannot guarantee whether additional charges will be imposed.

9. Payment

Payment must be made using one of the methods offered at checkout.

You confirm that:

  • you are authorised to use the selected payment method
  • the payment information you provide is accurate
  • sufficient funds or credit are available to complete the purchase

Payments may be processed by third-party providers such as Shopify Payments, Shop Pay, PayPal or other providers made available at checkout.

Those providers may apply their own terms and privacy policies.

10. Production, Shipping and Delivery

Because our products are made to order, a production period applies before dispatch.

Unless otherwise stated on the relevant product or checkout page:

  • production typically takes approximately one week
  • shipping typically takes approximately 10–15 business days after production
  • tracking information is provided when the order is dispatched

Any production, dispatch or delivery dates shown on our website are estimates rather than guarantees.

Delivery may be affected by:

  • customs processing
  • carrier delays or disruptions
  • severe weather
  • public holidays
  • peak seasonal demand
  • incorrect or incomplete address information
  • events outside our reasonable control

You are responsible for providing a complete and accurate delivery address.

If you notice an address error, contact us immediately at hello@dozerdrop.com. We cannot guarantee that an address can be changed once production or fulfilment has begun.

11. Delayed or Lost Parcels

If your tracking shows no movement for an extended period or your parcel appears to be lost, contact us at hello@dozerdrop.com.

We may need to investigate the shipment with the carrier or fulfilment partner before confirming that it has been lost.

If a parcel is confirmed as lost, we will provide an appropriate remedy, which may include a replacement or refund.

We are not responsible for a parcel being delayed, lost or returned because the customer supplied an incorrect or incomplete address, although we will try to assist where reasonably possible.

12. Returns, Refunds and Defective Products

Because our products are made to order, we generally do not accept returns or exchanges for:

  • change of mind
  • accidental purchases
  • incorrect design selection
  • incorrect size selection
  • normal wear and tear

This does not limit any rights or remedies that cannot legally be excluded.

If your order arrives damaged, defective, incorrectly printed, materially different from what you ordered or contains the wrong item, contact us within 30 days of delivery at hello@dozerdrop.com.

We may ask you to provide:

  • your order number
  • a description of the issue
  • clear photographs of the product
  • photographs of the packaging where shipping damage is involved

Once we have reviewed the claim, we will determine an appropriate remedy, which may include a replacement, refund or another remedy required by law.

13. Consumer Rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Where applicable consumer protection law gives you rights beyond these Terms, those rights continue to apply.

14. Promotions and Discount Codes

Promotions and discount codes:

  • may be subject to additional conditions
  • may expire at the stated time
  • cannot be exchanged for cash
  • may not be combined unless expressly permitted
  • may be limited to specific products, markets or customers

We may correct or withdraw a promotion where it contains an obvious error or is being used fraudulently or contrary to its stated conditions.

This will not affect an order already accepted unless the order involved fraud, unauthorised activity or an obvious pricing error.

15. Website Use

You may use our website only for lawful personal shopping and informational purposes.

You must not:

  • use the website for an unlawful or fraudulent purpose
  • provide false or misleading information
  • impersonate another person
  • gain or attempt to gain unauthorised access to the website or another account
  • introduce viruses, malware or harmful code
  • interfere with the website’s operation or security
  • scrape or systematically extract website content without permission
  • use automated tools to purchase limited products unfairly
  • bypass security, access controls or purchasing limits
  • infringe our rights or the rights of another person

We may restrict or suspend access where we reasonably believe these Terms have been materially breached or where doing so is necessary to protect the website, our customers or our business.

16. Intellectual Property

All content made available through the website, including our:

  • Dozer name and branding
  • logos
  • product artwork and designs
  • graphics
  • photographs
  • videos
  • written content
  • icons
  • page layouts
  • other creative materials

is owned by or licensed to us and is protected by applicable intellectual property laws.

You may view and use the website for personal, non-commercial shopping purposes.

You must not reproduce, distribute, modify, sell, license or commercially exploit our content without prior written permission.

Purchasing a product does not transfer ownership of any intellectual property associated with the product or its design.

17. Community Voting, Reviews and Submissions

We may invite customers or members of the Arthur’s Sleepy History community to vote on designs, provide feedback, submit suggestions or post reviews.

Participating in a vote does not create an entitlement to receive a product, payment, royalty or ownership interest.

If you submit a suggestion, photograph, review, comment or other content, you confirm that:

  • you have the right to submit it
  • it does not infringe another person’s rights
  • it is not unlawful, deceptive, abusive or defamatory
  • any statements you make are truthful to the best of your knowledge

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for operating, improving and promoting Dozer.

We may remove or decline to publish content that:

  • is unrelated to our products or services
  • contains unlawful or abusive material
  • reveals private information
  • contains spam or promotional links
  • is fraudulent or misleading
  • infringes another person’s rights

We do not prohibit or penalise genuine negative reviews.

18. Third-Party Services and Links

Our website may include links to or integrations with third-party services.

We do not control third-party websites and are not responsible for their content, availability, security or practices.

Your use of third-party services may be governed by the provider’s own terms and privacy policy.

19. Relationship With Shopify

Our store is hosted by Shopify, which provides the ecommerce platform through which we offer our products and services.

Purchases made through our store are transactions directly between you and Dozer. Shopify is not the seller of our products and is not responsible for manufacturing products, fulfilling orders or providing Dozer customer support.

Shopify and its service providers may process information associated with your use of the website and your purchases as described in our Privacy Policy and applicable Shopify privacy documentation.

Nothing in this section excludes any responsibility that cannot legally be excluded.

20. Accuracy and Website Availability

We aim to keep information on our website accurate and current. However, occasional errors, omissions or technical problems may occur.

We may correct errors and update website information where reasonably necessary.

We do not guarantee that the website will always be uninterrupted or error-free. Access may be temporarily suspended for maintenance, security or operational reasons.

21. Product and Health Disclaimer

Product statements relating to comfort, sleep or light blocking describe the product’s intended purpose and general characteristics.

Our products and website content are not medical advice and are not intended to diagnose, treat, cure or prevent any health condition.

Individual experiences may vary.

Nothing in this section limits any consumer guarantee or other right that cannot legally be excluded.

22. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising under non-excludable consumer guarantees.

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss that was not reasonably foreseeable when the relevant contract was formed.

Where our liability may lawfully be limited, our total liability relating to an order will not exceed the amount you paid for the affected product.

This limitation does not apply where applicable law requires a different remedy or does not permit the limitation.

23. Indemnity

To the extent permitted by law, you agree to compensate us for reasonable losses, liabilities and costs directly caused by:

  • your unlawful use of the website
  • your material breach of these Terms
  • content you submit that infringes another person’s rights

You are not required to compensate us for losses caused by our negligence, breach of law or wrongdoing.

Our collection, use, storage and disclosure of personal information are described in our Privacy Policy.

  • producing products
  • delivering orders
  • preventing fraud

The remaining provisions will continue to apply.

29. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean that we have waived our right to enforce it later.

30. Assignment

You must not transfer or assign your rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations as part of a sale, restructure or transfer of our business, provided that doing so does not reduce any non-excludable rights you have in relation to an existing order.

31. Entire Agreement

These Terms and the policies referenced in them form the agreement between you and us concerning your use of the website and purchases from Dozer.

They replace previous communications concerning the same subject, except for representations or rights that cannot legally be excluded.

32. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The courts of New South Wales have non-exclusive jurisdiction over disputes arising from these Terms.

Nothing in this section excludes any mandatory consumer protection or right to bring a claim in another jurisdiction that applies under the law where you live.
